TERMS AND CONDITIONS – ASHFORD ATELIER

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

Cooling-off period: the period within which the consumer may exercise the right of withdrawal;
Consumer: the natural person who is not acting in the course of a profession or business and who enters into a distance contract with the entrepreneur;
Day: calendar day;
Ongoing contract: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information;
Right of withdrawal: the option for the consumer to withdraw from the distance contract within the cooling-off period;
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;
Distance contract: a contract concluded within the framework of an organized system for distance selling of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract;
Means of distance communication: any means that can be used to conclude a contract without the consumer and entrepreneur being present in the same place at the same time;
General Terms and Conditions: these Terms and Conditions of AshfordAtelier.

Article 2 – Applicability

These Terms and Conditions apply to every offer made by AshfordAtelier and to every distance contract and order concluded between AshfordAtelier and the consumer.

Before the distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated where the Terms and Conditions can be reviewed and that they will be provided free of charge upon request.

If the distance contract is concluded electronically, the text of these Terms and Conditions will be made available electronically in such a way that the consumer can easily store them on a durable data carrier.

If specific product or service conditions apply in addition to these Terms and Conditions, the consumer may always rely on the provision that is most favorable to them.

If one or more provisions are wholly or partially void, the remaining provisions shall remain in force and any ambiguity shall be interpreted in accordance with the spirit of these Terms and Conditions.

Article 3 – The Offer

If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated.

All offers are non-binding. AshfordAtelier reserves the right to amend or withdraw offers.

The offer contains a complete and accurate description of the products and/or services offered. Images are a truthful representation, but colors may differ from reality.

All images, specifications, and data are indicative and cannot give rise to compensation or termination of the contract.

Each offer clearly states:

the price, excluding import VAT and customs clearance costs, which are borne by the customer;

shipping costs; FREE

the method of concluding the agreement;

applicability of the right of withdrawal;

payment, delivery, and execution methods;

the validity period of the offer;

available languages;

the minimum duration in case of an ongoing contract.

Article 4 – The Agreement

The agreement is concluded when the consumer accepts the offer and fulfills the stated conditions.

Electronic acceptance is confirmed electronically. Until confirmation, the consumer may dissolve the agreement.

AshfordAtelier takes appropriate technical and organizational measures to secure electronic payments and data transfers.

Orders may be refused if there are justified reasons related to payment reliability.

All agreements are subject to sufficient product availability.

Article 5 – Right of Withdrawal

The consumer has the right to withdraw from the agreement within 30 days of receiving the product, without stating a reason.

During the cooling-off period, the consumer shall handle the product and packaging with care and may only use the product to the extent necessary to assess it.

To exercise the right of withdrawal, the consumer must notify AshfordAtelier within 30 days of receipt by written message or email.

After notification, the consumer must return the product within 30 days. Proof of return may be required.

Failure to comply with these terms makes the purchase final.

Article 6 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, return shipping costs are borne by the consumer.

Any amount paid will be refunded within 30 days after withdrawal, provided the product has been received or proof of return shipment has been provided.

Article 7 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for:

custom-made products;

personal products;

perishable goods;

sealed hygiene products once opened;

sealed audio/video recordings or software once unsealed;

newspapers and magazines;

products subject to financial market fluctuations.

Article 8 – Price

Prices will not be increased during the stated validity period unless VAT rates change.

Delivery takes place outside the EU; import VAT and customs clearance fees may be charged by the carrier. AshfordAtelier does not charge VAT.

Prices are subject to typographical errors.

Article 10 – Conformity and Warranty

Products comply with the agreement and legal requirements.

Any warranty does not affect statutory consumer rights.

Defects must be reported within 30 days of delivery.

Warranty is void if products are misused, altered, or repaired by third parties.

Article 11 – Delivery and Execution

Orders are processed with due care.

The delivery address is provided by the consumer.

Orders are delivered within 30 days unless otherwise agreed.

Risk transfers upon delivery.

Article 12 – Ongoing Contracts

Consumers may cancel indefinite contracts at any time with a maximum notice period of one month.

Fixed-term contracts may not be automatically renewed.

Contracts longer than one year may be cancelled after one year.

Article 13 – Payment

Payments must be made within 7 business days unless otherwise agreed.

Incorrect payment details must be reported immediately.

Reasonable collection costs may be charged.

Article 14 – Complaints Procedure

Complaints must be submitted within 7 days of discovery.

Complaints will be answered within 24 Hour.

Article 15 – Disputes

All agreements are governed exclusively by Dutch law.

Article 16 – CESOP

Due to EU legislation effective from 2024, payment service providers may register transaction data in the European CESOP system.

Orders placed before 17:00 (GMT+01:00 – Amsterdam) are processed the same business day.

We ship with DHL, BPost, and FedEx. All orders include tracking.
